Wiluna Mining Resolves Legal Disputes Ahead of Scheduled Hearing

  • 3 min read

Wiluna Mining has settled four significant lawsuits, eliminating distractions and legal costs as it focuses on the Wiluna Gold Project.

Overview of the Settlement

Wiluna Mining and its subsidiaries, alongside AIM Mining Corporation and former administrators, have reached a comprehensive settlement concerning four notable lawsuits. This agreement, described as a "without admission basis in full and final," allows each party to cover its own legal expenses, thereby marking a significant step forward for Wiluna Mining.

Details of the Resolved Lawsuits

The four legal proceedings addressed in the settlement include:

  • COR 158 of 2025: Initiated by Milan Jerkovic against Wiluna and the former administrators, this Supreme Court case was set for a final hearing on November 23, 2026.
  • COR 169 of 2025: Focused solely on residual cost issues, this was brought by the former administrators regarding the deed administration of Wiluna Mining.
  • COR 175 of 2025: This case, also concerning residual costs, was filed by AIM against the former administrators and Wiluna Mining.
  • WAD 149 of 2026: Filed in the Federal Court by AIM, it pertained to Wiluna’s extraordinary general meeting held on May 15, 2026.

The Importance of Resolving Legal Matters

Settling disputes without going to trial means that no party admits liability, yet it alleviates the management burden and high legal costs associated with ongoing litigation. For mining companies like Wiluna, unresolved litigation can hinder operations and create uncertainty regarding their future financial health.

With this settlement in place, the previously scheduled final hearing for COR 158 is now canceled, further streamlining Wiluna's focus on its projects.

Management's Perspective on Settling Disputes

Wiluna's Managing Director, Victor Rajasooriar, emphasized the settlement as a pivotal move towards cleaning up the company’s past legal entanglements. He stated, "The Board believes that this settlement serves the best interests of both the Company and its shareholders by eliminating the distractions, costs, and time associated with the litigation. It marks a crucial step in de-risking legacy issues as we push forward with the Wiluna Gold Project."

This position reinforces three key investment case points:

  • It alleviates management's distractions, thus reducing costs and time.
  • The move is seen as crucial in de-risking past legal matters.
  • This allows the company to concentrate more on the advancement of the Wiluna Gold Project.

For investors, the message is clear: the resolution of these four disputes eliminates long-standing uncertainties and redirects focus toward future opportunities.
