Terms and Conditions

The terms on which Blockchain Data Wiki is made available to you, including acceptable use, intellectual property, disclaimers and limits of liability.

1. These terms

These Terms and Conditions govern your use of blockchaindatawiki.com and any content, feature or service made available through it (the “Site”). By accessing or using the Site you agree to them. If you do not agree, do not use the Site.

They incorporate our Privacy Policy, Cookie Policy and Disclaimer, each of which forms part of this agreement.

2. Changes

We may amend these terms at any time by posting a revised version with a new effective date. Changes take effect when posted and apply to use of the Site after that point. Where a change is material we will give reasonable prominent notice. Continuing to use the Site after a change means you accept it.

3. Who may use the Site

You must be at least 16 years old and legally capable of entering into a binding agreement. You must not use the Site where doing so would breach the law that applies to you, and you are responsible for determining whether that is the case.

4. Licence to use our content

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the Site for your own information. That licence does not permit you to:

  • reproduce, republish, redistribute or make available substantial parts of the Site;
  • use the Site or any part of it for a commercial purpose without our written permission;
  • scrape, harvest or systematically extract content, whether manually or by automated means;
  • use the Site or its content to train, fine-tune or evaluate a machine learning model without our written permission;
  • frame, mirror or present the Site as your own, or remove any attribution or notice from it.

Short quotations with clear attribution and a link to the original article are permitted and welcome.

5. Acceptable use

You must not: attempt to gain unauthorised access to the Site, its servers or any connected system; interfere with its operation or impose an unreasonable load on it; introduce malicious code; circumvent any access control or rate limit; or use the Site to send unlawful, defamatory, infringing, harassing or deceptive material.

6. Intellectual property

All content on the Site, including text, analysis, graphics, layout, code and the arrangement of it, is owned by us or licensed to us and is protected by copyright and other rights. Trade marks appearing on the Site belong to their respective owners, and their use does not imply any endorsement or association.

Photographs may be licensed from third parties. Where a photograph requires attribution, that attribution is given with the image, and a licence to reuse the surrounding article does not extend to it.

7. No advice, and no reliance

The Site is published for general information only. Nothing on it is financial, investment, legal, accounting or tax advice, and nothing on it is a recommendation, offer or solicitation to transact in any asset. We do not know your circumstances and have not taken them into account.

You are solely responsible for any decision you make and for any loss that results. Please read the Disclaimer in full, which sets out the risks of dealing in digital assets, including the risk of losing everything you commit.

8. Third-party content and links

The Site contains links to, and information drawn from, third parties. We do not control those parties, do not endorse them, and are not responsible for their content, products, services, accuracy, security or privacy practices. Any dealing you have with them is between you and them.

9. Availability

The Site is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, timely, error-free, secure or free of harmful components, nor that any defect will be corrected. We may change, suspend or withdraw all or part of it at any time without notice.

10. Disclaimer of warranties

To the fullest extent permitted by law, we exclude all representations, warranties, conditions and terms, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness or non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary loss, nor for any loss of profit, revenue, business, opportunity, goodwill, anticipated saving, data or trading loss, arising out of or in connection with your use of the Site, whether in contract, tort (including negligence), breach of statutory duty or otherwise, and whether or not we were advised of the possibility.

Where liability cannot lawfully be excluded, our total aggregate liability arising out of or in connection with the Site is limited to one hundred United States dollars (USD 100).

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, these terms do not affect your statutory rights.

12. Indemnity

You agree to indemnify us against any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the Site, or your infringement of the rights of any third party.

13. Suspension

We may restrict or withdraw your access to the Site at any time, without notice, if we reasonably consider that you have breached these terms.

14. General

If any provision is held unenforceable, the remainder continues in effect. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these terms; we may assign ours to a successor to the publication. These terms are the entire agreement between us regarding the Site.

15. Governing law and jurisdiction

These terms and any dispute arising out of them, including non-contractual disputes, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere you retain the benefit of any mandatory protections and the right to bring proceedings in the courts of your own country of residence.
