UK FCA Seeks Input on DeFi Regulations Ahead of 2027 Framework

The UK's FCA is inviting feedback on DeFi regulations and exemptions as part of upcoming crypto rules set to take effect in 2027.

The UK's Financial Conduct Authority (FCA) has initiated two consultations aimed at establishing clearer regulations for decentralized finance (DeFi) operations. These consultations will help determine how crypto activities may be regulated under a new framework set to launch in October 2027.

Clarifying Compliance for DeFi Businesses

Focused on businesses leveraging decentralized protocols, the first consultation, designated GC26/7, emphasizes compliance with existing operational resilience and financial crime regulations. Despite the automated nature of DeFi through smart contracts, the FCA asserts that regulated entities must uphold compliance obligations.

This proposed guidance outlines key areas including:

  • Operational resilience requirements under SYSC 15A.
  • Compliance protocols and financial crime controls as per SYSC 6.
  • Regulations from the UK’s Money Laundering Act.

According to the FCA, the unique open structure of DeFi systems poses risks, including operational failures and potential financial crime, especially without traditional intermediaries. While the consultation suggests practices to mitigate these risks, it does not create a distinct regulatory framework specific to DeFi.

Potential Exemptions Under the New Framework

The second consultation, CP26/36, is centered on identifying which crypto activities may be exempt from FCA authorization under the upcoming regulatory regime. Changes are underway as part of the draft Cryptoassets (Miscellaneous Amendments) Regulations 2026 which outlines exclusions for certain services involving digital assets.

Exempt activities include:

  • Temporary holding of specified UK stablecoins during payment processes.
  • Proprietary trading done without offering services to others.
  • Market-making practices on regulated trading platforms.

The guidance clarifies that reliance on smart contracts or decentralized mechanisms does not automatically imply regulatory exemption. The requirements hinge on the specific services being rendered and whether they fall under existing laws that govern crypto activities.

Adjustments to Application Processes

The FCA has noted that regulatory updates have led to some uncertainty for firms readying their application for authorization. To alleviate this, businesses affected by specific technical service exclusions may receive extended time to submit necessary application materials, provided they have made genuine progress on their submission.

Starting from September 30, 2026, existing UK crypto businesses can start applying for authorization, with the final date set for February 28, 2027. Those who apply within this timeframe can continue to offer qualified crypto services while their applications are under review, although a submitted application does not guarantee approval. Moreover, standing registrations under the Money Laundering Regulations won't automatically transition to the new system.

Industry Response and Future Considerations

Feedback from industry representatives has been generally positive, with calls for proportionate regulations that consider the unique nature of decentralized services. The UK Cryptoasset Business Council particularly emphasizes the importance of defining clear regulatory boundaries to prevent pushing DeFi operations outside of the UK market.

As the industry awaits the FCA’s finalized guidance, it remains critical for crypto businesses to stay informed and prepared ahead of the evolving regulatory landscape.
